Divorce is extremely difficult for everyone involved. It can be a disruptive and unsettling time and one where you will need as much support and guidance as possible.

You can begin proceedings once you have been married for over a year. In order to file for divorce you need to be of the belief that your marriage has irretrievably broken down. To do so you need to justify one of the following reasons:
- Your partner has shown unreasonable behaviour
- Your partner has committed adultery
- Your partner has deserted you
- You and your partner have lived apart for two years and both consent to divorce
- You and your partner have lived apart for a period of five years, irrespective of mutual consent
Before proceedings can begin you need to file what is known as a divorce petition. This is sent to the court and states why you believe that your marriage has broken down beyond repair. A copy will be sent to your partner and they will then have the chance to respond. Provided that the petition is not challenged, you can request that the court grants you a divorce.
