Redundancy is a lawful reason to dismiss an employee. However, it is possible that you can launch a claim for unfair dismissal even when the reason for redundancy appears to be genuine.
A claim for unfair dismissal could arise in a number of circumstances, for example if:
The employer failed to follow a fair procedure
The employer failed to follow a fair consultation process
The employer did not use a fair and objective selection process when choosing who to select for redundancy
The employer unfairly selected the employee for personal reasons and / or other employees were favoured
The employer could have offered or created another role
The employer could have made someone more junior redundant in order to retain the more senior employee
