The employment team at Tayntons helped a client who sadly had suffered a cardiac arrest. He had previously been employed as an engineer and whilst recovered, his medical condition meant that he suffered short term memory loss and slower movement.
On his return to work, the employer did little to accommodate his disability which made his day to day duties very difficult. After a non-paid trial period, the employer offered him a significantly reduced salary than originally advertised on the grounds of his medical condition and he was eventually dismissed.
Our solicitors advised that he had a strong case for unfair dismissal on the basis that the employer had failed to make any reasonable adjustment for his return to work. We were able to argue that our client had received less favourable treatment as a result of his illness and had suffered disability discrimination in the workplace. We obtained an out of court settlement worth over £13000 in a case that lasted approximately nine months.
