Other common claims

Other Employment Tribunal Claims exist such as:

  • Equal pay

This is a highly complex area of law. If you believe that you’re being paid an amount which is not commensurate to a colleague of the same sex, call our employment solicitors now to understand your position.

  • Detriment

If you’ve raised a complaint of whistle blowing and find that you are treated differently or unfairly as a result, you may be suffering from a detriment.

  • Unlawful deduction of wages

An employer only has limited rights to deduct monies from your wages such as statutory payments (tax and NI) or if allowed by a contract e.g. if you have taken more holiday than you are entitled to.

If you believe that you are not being paid correctly or have had monies deducted from your wages we can assess if such a claim exists.

  • Breach of contract

This type of claim could arise if your employer breaches your contract of employment, typically in notice or bonus payments for example.

  • Restrictive covenants

Employers often use restrictive covenants as a way of protecting their business after your employment has terminated. If an employer discovers a breach of a restrictive covenant, this can lead to legal action against the former employee for either an injunction or pursuit of the financial losses flowing from the breach.

This could prevent you from working or result in you losing your job, and where the defence of any legal action is required, the legal fees can be substantial.

Restrictive covenants can occasionally be complicated to understand. Our employment solicitors can help you to make sense of them from the onset, assessing their legal enforceability and advising on the risks of proceedings in each case. If you have been contacted by a former employer for an alleged breach, you should contact a solicitor immediately.
